Terms of Service
These Terms govern your purchase, download, and use of Cymatik from Sensory AV LLC. By purchasing or using Cymatik, you agree to these Terms and the Software License.
Pre-release software
Cymatik v1.0.0-pre.3 is pre-release software under active development. Features, presets, compatibility, performance, interfaces, and file formats may change. Pre-release builds may contain defects. Save backups of important presets and exported work.
Purchase and delivery
Pre-release access is currently offered for a one-time $29.99 payment with no subscription. Purchase provides a license key for the current pre-release and updates we release through the v1.0 milestone. Customers who purchased at an earlier promotional price keep their existing license and update entitlement. An internet connection may be required for purchase, download, activation, key recovery, and update checks.
Seven-day refund policy
You may request a full refund for any reason within seven calendar days after purchase. Email ryan@sensoryav.com from the purchase email and include enough information to locate the transaction. Approved refunds are returned to the original payment method through Stripe; bank processing time may vary. After a refund, the associated license may be deactivated and you must stop using the software.
This policy does not limit non-waivable rights provided by applicable consumer law.
Compatibility and performance
Current stated minimums are Windows 10/11 64-bit or macOS 14 Sonoma or later with a compatible GPU. macOS 12 Monterey and macOS 13 Ventura are not supported. Actual playback and export performance depend on hardware, drivers, operating system, resolution, effects, and available runtime codecs. MP4, WebM, MIDI, Syphon, 4K, and frame-rate options are subject to the platform qualifications described on the product page and documentation.
Acceptable use
You may not use Cymatik to violate law, infringe another person's rights, distribute malware, attack or interfere with the licensing service, bypass activation limits, share a license key outside your licensed use, or redistribute the software. Your use of music, recordings, branding, and other source material must respect the rights of their owners.
Support and changes
Support is provided by email on a reasonable-efforts basis. We may update, replace, suspend, or discontinue pre-release builds or online services when necessary for development, security, legal compliance, or operations. Roadmap items are plans, not guaranteed release dates or final specifications.
Disclaimers and liability
To the fullest extent permitted by law, Cymatik and related services are provided "as is" and "as available," without warranties of uninterrupted or error-free operation. Sensory AV is not liable for indirect, incidental, special, consequential, or lost-profit damages. Our aggregate liability arising from Cymatik will not exceed the amount you paid for the license during the twelve months before the claim. These limits do not apply where prohibited by law.
General
If one provision is unenforceable, the remaining provisions continue in effect. Failure to enforce a provision is not a waiver. These Terms, the License, and Privacy Policy form the agreement regarding Cymatik. We may update these Terms prospectively by posting a revised version and effective date.
